Mango Designs utilises various third-party APIs, endpoints, and services to build, host, and manage websites for our clients. These services have associated costs that are calculated based on usage. This Fair Use Policy ensures that all clients use our services responsibly and that no single client causes disproportionate costs that affect our ability to serve others.

2. Prohibited Activities

Businesses must not intentionally or negligently overload, abuse, or excessively use any APIs, endpoints, or services that power their website. Prohibited activities include, but are not limited to:

• Automated scripts that make excessive API calls
• Intentionally generating high volumes of traffic to inflate usage
• Using services in a manner inconsistent with normal business operations
• Exploiting any service vulnerabilities or loopholes
• Running processes that consume disproportionate server resources
• Any activity designed to circumvent usage limits or monitoring

3. Determination of Unfair Use

What constitutes "unfair use" or "overloading" shall be determined solely at Mango Designs' discretion. We monitor usage patterns and reserve the right to identify and address any usage we deem excessive, unusual, or outside the scope of normal business operations. Our decision in such matters is final.

4. Consequences of Violation

If Mango Designs determines that a business is using our services unfairly or in violation of this policy, we reserve the right to take any of the following actions at any time and at our sole discretion:

• Request Additional Payment: We may require the client to pay increased subscription fees or additional charges to cover the excess costs incurred due to their usage.
• Modify Service Terms: We may change the terms of your agreement, including pricing, usage limits, or service features.
• Suspend Services: We may temporarily suspend access to services until the issue is resolved or payment is received.
• Terminate Contract: We may terminate the business contract entirely, with or without prior notice, depending on the severity of the violation.

5. Why This Policy Exists

We rely on third-party APIs and services to deliver high-quality websites and functionality to our clients. These services charge us based on usage. When a client's usage significantly exceeds normal levels, it directly increases our operational costs. This policy protects both Mango Designs and our other clients from bearing the burden of another party's excessive usage.

6. Good Faith Usage

We expect all clients to use our services in good faith and in a manner consistent with typical business needs. If you anticipate high-volume usage or have specific requirements that may exceed normal usage patterns, please contact us in advance so we can discuss appropriate arrangements and pricing.

7. No Refunds for Policy Violations

If your contract is terminated due to a violation of this Fair Use Policy, you are not entitled to any refund of fees already paid. Any outstanding charges for excess usage must be paid in full.

8. Policy Updates

Mango Designs reserves the right to update this Fair Use Policy at any time. Continued use of our services following any changes constitutes acceptance of the updated policy.
